Subscription Term: The subscription term commences on the day that you sign up for your “Ezee PC Protection Subscription” and expires 12 months later. Please note that, in an unlikely even of “us” breaching our service obligation, “you” have no right to terminate this Subscription Agreement at will. |
| B. |
”Our” Service obligations to “you”: Provided that you have complied with “Your Obligations” (as mentioned below) at all relevant times, Prompt PC Services will provide you with the “Ezee PC Protection Services” as described below during the “Subscription Term”.
You may request any of the Subscription Services during the term of this Subscription Agreement by calling us on ABC EFG during the hours set out below.

Nominated Computer: This is the desktop or laptop computer nominated by “The Subscriber” at the time of signing up for the Prompt PC Services Subscription.
Nominated Computer needs to meet the below requirements at all times:
- Meets the minimum hardware specifications for running the operating system or software that customer wants to run;
- It needs to run Windows 98 or newer operating system;
- Have legitimate copies of all software and operating system on your Nominated Computer, as well as all installation disks/media and product keys ready to use when you ring us about a problem;

Nominated Location: This is the physical location where the “Nominated Computer” will be located during the “Subscription Term”. |
| E. |
Subscriber’s (You)’s warrant to Prompt PC Services:

They are the legal owner, or have full right to control the use of the Nominated Computer;

They are the legal owner or the licensee of all copyright subsisting in the systems, programs and data in the Nominated Computer; and
-
They have the right to grant the consents, permissions and licences granted in this clause 4.

Services outlines in this clause are the services Prompt PC Services is obliged to offer to its subscribers:
- Repair:
Below are the computer repair services that will be covered by the Ezee PC Protection:

Networking:
Below are the network related services that will be covered by the Ezee PC Protection:
- Setup of new home network (wired or wireless) up to twice per subscription term;
- Troubleshooting your existing home network to find out what is wrong;
- Connecting your nominated computer to your existing home network and teaching how to do it again;
- Configuring your computer to access any shared resources in the network and teach how to share resources in local network;
- Making sure you can access the internet through your network;
- Hardware and Software Installation:
Below are the hardware and software related services that will be covered by Ezee PC Protection:
- Teaching you how to install hardware on your computer;
- Teaching you how to install software programs on your computer;
- Teaching you how to installing relevant drivers and software to make the hardware device work with full efficiency;
- Testing your hardware to make sure there are no faults and to ensure it is working properly.

Ezee PC Protection “Exclusions”:
The Ezee PC Service Subscription does not include the services mentioned in this clause. Although members of Ezee PC Protection will be eligible for up to 50% discount an additional required services.
Some specific services that are NOT included in the Ezee PC Protection subscription are as follows:
- Hard drive formatting re-installing of operating system;
- The provision of new or replacement hardware or software;
- Fixing software bugs that are inherent in the software;
- Installation or up gradation of hardware;
- Virus and spyware removal where the Nominated Computer is not running licensed anti-virus and anti-spyware software.
- Software upgrades or new software releases;
- Training or instruction in how to use features of a software program other than as required to address the current technical problem;
- Advanced network services;
- Situations where the manufacturer of the application or technology has not yet, provided a solution to a problem;
- Data recovery or data back-up services;

Supply of my Subscription Services:
The Ezee PC subscription services are:
- Remote telephone support or onsite services as required (to be decided by Prompt PC Services experts);
- Provided to a single nominated home computer only “Nominated Computer” via use of our remote connection tool which requires an uninterrupted broadband internet connection. In a situation where the problem cannot be fixed by a remote internet connection, Prompt PC Services will arrange for a technician to be sent to “Nominated Computer”’s location.
- In some instances, it might me quicker to resolve the issue in our workshop. In such cases, customer would be advised of the situation with a reason why those circumstances have arisen.
- Extra charges may be applicable if the location of the “Nominated Computer” is different to the “Nominated Location” of the computer at the time of sign up.
- Only provided from 8am until 11pm (AEST) Monday to Friday and from 8am until 11pm (AEST) on Saturdays and Sundays.

Change of “Nominated Computer”:
Subscriber is allowed to change the “Nominated Computer” once a year ONLY if he satisfies following conditions:
- By providing a documentary evidence that the “Nominated Computer” is stolen or if that computer has been disposed of and replaced with another computer; and
- By requesting that transfer in writing at least 14 days prior to booking any service request.

Subscriber obligations: “You” must:
- Have a broadband internet connection;

Follow our instructions to download necessary software on your “Nominated Computer” to enable the remote access tool to connect;
- Back-up all files before you call us for your assistance;
- Have "administrator" rights and access to your Nominated Computer;

Provide your subscription reference number when you ring us to request Ezee PC Protection Service;

Follow and accept the instructions, suggestions and advice of our professional support personnel during calls;

Be the legal owner of the Nominated Computer and be at the location of the Nominated Computer if on-site visit is required;
- Comply with the fair use policy set out in clause 9;
- Ensure that your Nominated Computer fulfils all the requirements as stated above:

Consents and authorisations:
- You consent to us accessing and controlling your Nominated Computer in order to provide the required services to you.

You hereby authorise us all access to, modification of or impairment to your data and/or computer system as part of our provision of the required services.

You hereby permit us do everything required and legally permitted on your Nominated Computer (including its systems, programs and data) for the sole purpose of providing you with Prompt PC Services.

You acknowledge that some problems cannot be fixed over the telephone, remotely or even while we are on-site and authorise us to take the Nominated Computer to our workshop to fix the problem as early as possible.

Payment :
Your Subscription Fee is payable, via any of the payment methods accepted by Prompt PC Services. It is to be paid at the time you sign up for your Ezee PC Subscription. Subscriber needs to provide the reference number on the receipt of payment received when requesting the “Ezee PC Subscription service” during the “subscription term”.

Fair Use Policy :
Excessive, unreasonable or fraudulent use of any of the service included in Ezee PC Subscription may impact the quality and reliability of Ezee PC Service.
To ensure this does not occur, all subscribers’ needs to follow the fair use policy terms mentioned below:
“You” must not:
- Make fraudulent use of the Ezee PC Protection Services;
- Make multiple service requests caused by a lack of regular maintenance;
- Make repeat service requests caused by your failure to act on our recommendations;
- Any subscriber must not make more than 4 service requests per month. Doing so, may end up in termination of their service contract.
- Ezee PC Protection subscriber is entitled to a minimum of 20 Service Calls per nominated PC per subscription term.

Privacy :
Any personal information collected by us during your Ezee PC Protection service delivery will be dealt with in accordance with our "Privacy Policy" which can be accessed at http://promptpcservices.com.au/privacy.html |
| 10. |
Liability : Some warranties and guarantees are implied by law, and cannot be excluded by us, except to a limited extent. To the extent we can limit such liability, we limit our liability to (at our election):
- in the case of goods, at our election, to the cost of:
- Replacement of the goods;
- Supply of equivalent goods;
- Payment of the cost of replacing the goods or acquiring equivalent goods; or
- The repair of the goods or payment of the cost of having the software repaired.
- in the case of services supplied to you, at our election, to the cost of:
- Supplying the services again; or
- The payment of the cost of having the services supplied again.

Governing Law :
This Subscription Agreement is governed by the laws of New South Wales.
|
| 12. |
Termination for breach :
Without prejudice to our other rights at law, we may cease supply of goods or services to you immediately by giving notice in writing if you breach any condition of this agreement.
