Terms and Conditions
 
Definitions:
“us” means Prompt PC Services (ABN 15 703 764 602) of 29, 2-10, Powell St, Homebush, NSW – 2140 and and includes its PC advisors, technicians, employees, agents and contractors.

The Subscriber, The Customer, "you"
Any person or company that is provided goods or services by Prompt PC Services;
Service Call means an up-to 1 hour visit by “us” at customer’s place

Nominated Computer means the desktop or laptop computer nominated by “you” at the time of requesting a service from Prompt PC Services.

Remote Service means providing requested service to customer by remotely connecting to their nominated computer by using out remote connection software;

Workshop means a location pre-disclosed by Prompt PC Services where offsite computer repairs are conducted;
 
Conditions of service:
Unless otherwise agreed by Prompt PC Services in writing or over the email, the conditions listed on this page apply exclusively to every customer who is provided services by us. This terms and conditions cannot be varied or supplanted by any other terms or conditions without the prior written consent from Prompt PC Services.

Any written quotation provided by Prompt PC Services is valid for 14 days from the issue date of the quotation unless a different quotation due date is provided by “us” in writing to the customer.
These terms and conditions on this page may be supplemented by additional terms which are provided to the customer in writing before the provisioning of service.

Prompt PC Services has got rights to change/amend the initial quotation provided after the initial assessment of the problem or service request. If the new quotation is not acceptable by customer, they would not be charged and no service would be provided to customer.
 
Attempted Repairs:
In an unlikely situation where a staff member of Prompt PC Services is not able to repair the nominated computer to good working order, further PC Service may be refused and workshop service may be recommended. In such an event, customer would not be charged any fees and a written quotation could be provided to customer for any additional service requests.
 
Software and Hardware supply:
Any service provided by Prompt PC Services does not include the supply of software or hardware material or spare parts. Where these parts are required, customer would be provided with a quotation for the required part or software and customer must pay in advance before any such part is provisioned.
 
Loss of Data :
Although we do take backup of the important data on the computer before performing any service on a nominated computer, Prompt PC Services shall not be held liable for loss of data on nominated PC while PC repair (or any other related service) is being conducted. It is the customer’s responsibility to ensure that all data is backed prior to arrival of us for on-site repair.
 
Performance of Service:
Any time and date for delivery of goods services stated by Prompt PC Services is intended as an estimate only and is not a contractual commitment. Prompt PC Services will use its reasonable endeavors to meet any estimated dates for delivery of the requested services by customer.
 
Customer’s Responsibilities:
It is the customer’s responsibility to ensure that all data is backed prior to arrival of us for on-site repair.

Customer shall be solely responsible for all data inputs, the manner of use of the goods by all those to whom it provides access and all outputs derived, and all other results of such processing.

Customers must provide their licensed copy of the operating system and the software license key, and manufacturer’s drivers for hardware and software used by the nominated PC. In some cases, Prompt PC Services can source driver files in advance, if we are instructed to do so upon booking the job.

Where a nominated PC cannot be accessed because of lost password or system lock we will make all attempt to access the PC. In case if Ezee PC Technician cannot unlock or access the PC, they may suggest a full system reinstall.

Ezee PC Protection subscriber is entitled to a minimum of thirty Service Calls per nominated PC per subscription term.

Payment and Charges:
Payment for goods and services must be made by cash or credit card on or prior to the completion of the provision of goods or services.

Credit Card surcharge of 2.75% will be applicable for all payments received via credit card.
At Prompt PC Services’ discretion, service calls could be chargeable after initial 1 hour of troubleshooting. For any such instance, customer would be notified of it prior of any charges applied or any work conducted.

All software or hardware supplied by Prompt PC Services will be charged separately and needs to be paid for before the provisioning of the goods.

Where there is any change in the costs incurred by Prompt PC Services in relation to the goods or services, Prompt PC Services may vary its price for goods or services on order to take account of any such change, without giving notice to the Member.

Call-out fees may be applied at rates dependent on the member's on-site address in relation to the Service Zone.

In case of a default or late payment, Prompt PC Services has right to charge customer interest on any sum due at the rate of 3% above the corporate reference rate of Prompt PC Services principal banker. This interest shall be calculated on daily basis for the period from the due date until the date of payment in full.

Prompt PC Services has right to charge the Customer for all expenses and costs (including debt collection commission and fees, legal costs on a full indemnity basis and dishonored cheque fees) suffered or incurred by us resulting from the default and in Prompt PC Services taking whatever action it deems appropriate to recover any amounts due.
 
Prompt PC Services Warranties
If Prompt PC Services is not able to fix or diagnose your problem, we will not charge you for those services in respect of that problem. In some cases, the solution may be that you need to upgrade or replace your software or hardware. If we advise you to do so and you choose not to upgrade or replace your software or hardware, you acknowledge that we have met our commitment to you by providing you with a solution to your problem, whether or not you choose to implement that solution.

All goods and services supplied shall be free from defects in materials and workmanship for a period of 14 days from the date of delivery.

This warranty does not apply in circumstances where:
  • the goods or services are not defective;
  • the goods were used or services required for a purpose other than for which they were intended;
  • the goods were repaired, modified or altered by any person other than Prompt PC Services;
  • the defect has arisen due to misuse, neglect or accident;
  • the defect has arisen due to normal wear and tear on the goods;
  • the goods have not been stored or maintained as recommended by Prompt PC Services or the manufacturer; or
  • the Member is in breach of the terms and conditions.
Copyright in Software
Prompt PC Services will not be responsible to the customer or any third party for any breach of any software license agreement in respect of software provided to Prompt PC Services by the customer to be installed on the nominated PC.
